Judge Rotation Order for 2008
STATE OF WISCONSIN - CIRCUIT COURT - PORTAGE COUNTY
In the Matter of:
ROTATION OF JUDICIAL ASSIGNMENTS

of Wisconsin
AMENDED ROTATION ORDER
WHEREAS, pursuant to SCR 70.23(3), rotation of judicial assignments was created
by Order of September 14, 2007, and said Order will expire December 31, 2008;
NOW, THEREFORE IT IS HEREBY ORDERED that for the period of January 1, 2008,
through December 31, 2008:
(A) The Judge of Branch 1 is assigned to exercise jurisidiction in:
- All Chapter 767 family proceedings except:
- Actions for postjudgment relief remain with the original judge.
- Temporary hearings and orders are assigned to the Family Court Commissioner.
- All child support establishment and enforcement actions intiated by the Child Support office are assigned to the Family Court Commissioner.
- All initial appearances and pretrials in paternity actions are assigned to the Family Court Commissioner, including establishment and enforcement of child custody and placement orders.
- All actions for postjudgment relief in paternity proceedings are assigned ot the Family Court Commissioner.
- All JD(John Doe) filings.
- All reviews of the actions of the Family Court Commissioner.
- All Chapter 51 Mental Health Act proceedings including juvenile commitments, and all Chapter 980 sexual predator commitment and recommitment proceedings.
- All probate and guardianship matters.
- Traffic, criminal traffic, and ordinance cases for Stevens Point and Plover.
(B) The Judge of Branch 2 is assigned to exercise jurisdiction in:
- All civil actions, including miscellaneous proceedings and writs.
- Review and appoint Condemnation Commissioners and Drainage Board Commissioners as necessary.
- Traffic, criminal traffic, and ordinance cases for Portage County and State of Wisconsin.
- All proceedings under Chapter 48 and Chapter 938 Children's Code, including adoptions, and juvenile ordinance violations.
(C) The Judge of Branch 3 is assigned to exercise jurisdiction in:
- All criminal proceedings, except felony and misdemeanor criminal traffic.
- All Chapter 799, Small claims actions.
The Judges shall each be responsible to conduct traffic, ordinance, criminal intake and preliminary hearings on Tuesdays for four-week periods on a rotating basis. The intake Judge is responsible for issuing occupational licenses (and emergency matters when assigned judges aren't available.) Each judge is responsible on a rotating schedule with the Court Commissioners to conduct Riverside reviews. The judge assigned criminal jurisdiction has priority for establishing plea and pretrial dates. The judge with the carryover criminal rotation has second priority to establish plea and pretrial dates.
All pending cases shall be completed by the judge presently assigned.
